The Health Insurance Portability and Accountability Act of 1996 (HIPAA) is a familiar element of our medical care. We routinely sign releases specifying to whom our information can be released. A HIPAA release designating an appointed Agent under a Durable Power of Attorney, an Executor appointed under a Will, or the Trustee of a Trust is an essential element of your estate plan. Without it, your Agent, Executor or Trustee may not have access to the information needed to make decisions on your behalf.
